Terms of use
Effective: 13 October 2026
These terms are the agreement between you and ZARFA s.r.o., ID 04573021, registered office at Arnošta Valenty 639/5, 198 00 Praha, Czechia ("we", "us"), for the Tembira app and the backend we run for it (together, "Tembira").
Tembira is a conversation game for one phone: you pick a pack and a level, and pass the phone around a table or between two people, answering questions out loud. By installing or using Tembira you agree to these terms. If you don't agree, please don't use it. How we handle personal data is in our separate Privacy policy.
1. Who can use Tembira
Tembira is rated 4+, and anyone can play. Some packs are written for families with children, others for couples or friends; each pack says who it's for.
Nobody needs an account to play. A purchase belongs to the person whose Apple ID or Google account it was made with, and an account, if you have one, to the person who signs in. To make an account you must be old enough to agree to these terms where you live (18 in most countries), or have a parent or guardian agree to them for you. A parent or guardian who lets a child use their phone or account is responsible for that use and for any purchases made with it. Children can play on a grown-up's phone.
It's up to you to choose a pack and a level that suit the people at your table.
2. What Tembira is
Tembira gives you packs of questions at three levels (light, personal and deep), with the turn-taking, timer and recap that run a conversation. Some packs may be free. Paid packs let you try some of their questions before you buy, and unlock in full once bought (section 5). The questions come from our servers, so you'll need a connection to get new questions; packs you own keep playing offline from the last copy on your phone.
We'll keep improving Tembira, and that means we may add, reword, replace or retire individual questions, and change or remove features. We aim to keep it available and working well, but can't promise it will always be uninterrupted or free of errors.
3. How it's meant to be played
Every question is an invitation, never an obligation. Anyone can pass on any question, at any time, without giving a reason, and anyone can end the conversation. Passing is a normal part of playing, not a breach of anything. Please don't press someone to answer, and don't hold a pass against them.
What people share during a conversation belongs to them. Don't record, photograph or share someone's answers without their clear permission.
Some questions, especially in the deeper levels, may bring up feelings or memories. Tembira is a game, not therapy, counselling or medical advice, and it can't stand in for any of them. If a conversation becomes hard, it's fine to stop. If you or someone with you might be at risk, contact your local emergency services.
Tembira runs on a phone in a room we're not in. We can't see who is playing or how a question lands, so looking after each other at the table is up to the people there.
4. Playing as a guest, and accounts
You don't need an account to play, or to buy. The first time you open Tembira, it gives your install an anonymous guest id, shown in Settings as the Support ID. Your purchases, votes and feedback are kept with it, and it's how we find them when you write to us.
You can delete your data at any time in the app (Settings → Delete my data). The app then carries on as a new guest. Deleting doesn't refund your purchases: they stay with your Apple ID or Google account and come back with Restore purchases. It also doesn't cancel a subscription, if you have one (section 5).
An account is optional. If you have one (Sign in with Apple, Google Sign-In, or an email address and password), keep your sign-in details safe; you're responsible for what happens under your account. Tell us if you think someone else has been using it. You can delete it at any time in the app (Settings → Delete account), and the same goes for your purchases and any subscription as above.
5. Purchases
Everything paid in Tembira is bought through in-app purchase on the App Store (or Google Play, once the Android app is out). The price is shown in the app before you buy, with any taxes the store adds. Apple or Google takes the payment; we never see your card details.
Packs
Today, paid packs are one-time purchases: you pay once, and nothing renews. Packs are sold separately in each language (for example, Couples in English and Couples in Czech are two purchases). Buying one unlocks all of that pack's questions in that language, at every level, on any phone where you restore purchases with the same Apple ID or Google account, for as long as we run Tembira. A purchase covers that pack in that language only, not other languages or packs we add later.
As with the rest of Tembira, we may reword, replace or add questions inside a pack you own. We won't take a pack you've bought away from you, or move it behind a subscription, except where the law requires it or we stop offering Tembira altogether.
Subscriptions, if we offer them
We may later offer access as a subscription. If we do, and you choose one:
- It renews automatically at the end of each term (for example monthly or yearly) until you cancel. The app and the store show the price, the term and what's included before you subscribe.
- Cancel in your Apple ID's Subscriptions settings (or Google Play → Subscriptions) at least 24 hours before the renewal date. You keep access until the end of the term you've paid for, and it then doesn't renew.
- Free trials or introductory prices, if offered, show their length and the price that follows. Unless you cancel before the trial ends, the paid subscription starts automatically.
- Deleting your data or your Tembira account doesn't cancel a subscription. Apple or Google keeps charging until you cancel it with them.
- If we change a subscription's price, Apple or Google will tell you before it applies and, where their rules or the law require it, ask you to agree.
Restoring, refunds and family purchases
Restoring. On a new phone, tap Restore purchases in the app's Settings. It matches purchases made with your Apple ID or Google account; you don't need to sign in to Tembira.
Refunds. Apple and Google handle refunds under their own policies, and we can't issue one directly. Any rights the consumer law of your country gives you, including the EU and UK rules on digital content and on cancelling a contract, apply in addition to this section and aren't reduced by it.
Children's devices. If a child uses their own phone, Apple's Ask to Buy or Google Family Link lets a parent approve purchases first. Purchases made with your Apple ID or Google account are your responsibility (section 1).
No ads. Tembira doesn't show advertising. If that ever changes, we'll update these terms and the Privacy policy first and ask for your consent where the law requires it.
6. Our content and your licence
The app, its design and its questions belong to us or our licensors. We give you a personal, non-exclusive, non-transferable licence to use Tembira for your own, non-commercial play. Please don't copy, scrape, publish, resell or redistribute the questions or the app, or use them to build another product, unless the law gives you a right to or we've agreed in writing.
Ideas and feedback you send us, including on our roadmap board, are welcome; we may use them to improve Tembira without owing you anything for them.
7. Fair use
Please don't:
- use Tembira for anything illegal, or to harm, harass or exploit anyone;
- record or share another player without their permission (section 3);
- try to break or get around our sign-in, App Check, purchases or servers, or get into someone else's account;
- reverse-engineer, decompile or extract the app's questions or code, beyond what the law allows despite this term;
- use Tembira if sanctions or export-control law forbids us from dealing with you.
8. Suspension and ending
You can stop using Tembira and delete your data (or your account, if you have one) at any time. We may warn you, or limit, suspend or close your access (your guest id or account) if you seriously or repeatedly break these terms, put someone else at risk, or if the law requires it. Where we can, we'll tell you why first. If your access is closed, your licence under section 6 ends with it. Closing it doesn't cancel a store subscription; cancel it with Apple or Google. The parts of these terms that naturally continue (sections 6, 9, 10 and 11, among others) still apply afterwards.
9. No guarantees
Tembira is provided "as is" and "as available". As far as the law allows, we don't give warranties beyond those the law requires, including that it will always be available or free of errors, or that a particular question will suit a particular table. Nothing here takes away a warranty or remedy that consumer law gives you and doesn't let us exclude.
10. Liability
Tembira shows questions; what people choose to say or do with them is up to them. As far as the law allows, our total liability to you for anything to do with Tembira is limited to the greater of what you paid us for packs in the 12 months before the claim, or EUR 50, and we aren't liable for indirect or consequential losses such as lost profits or lost data.
None of this limits liability that the law doesn't allow us to limit, including for death or personal injury caused by our negligence, for fraud, or under mandatory consumer-protection law. If you're a consumer in the EU, EEA, UK or Switzerland, your statutory rights are unaffected.
If you're located in the United States, you and we agree that claims will be brought only individually, not as part of a class or representative action, to the extent that's enforceable where you live.
11. Governing law and disputes
These terms are governed by Czech law, without its conflict-of-law rules and without the UN Convention on Contracts for the International Sale of Goods. If you're a consumer, the mandatory consumer protections of the country you live in still apply. Czech courts have jurisdiction, but if you're a consumer in the EU, EEA, UK or Switzerland, you may also bring a claim in the courts where you live, and we can only bring one against you there.
If you're a consumer in the EU, you can also take a dispute to an out-of-court consumer dispute body. In the Czech Republic that's the Czech Trade Inspection Authority (ČOI). Please write to us first; most things can be sorted out by email.
12. App Store and Google Play
If you got Tembira from Apple's App Store, these terms also apply, and take priority where they conflict with anything above:
- These terms are between you and us, not Apple. Apple isn't responsible for Tembira or its content.
- Your licence is to use Tembira on Apple devices you own or control, as Apple's Usage Rules allow, including through Family Sharing.
- We, not Apple, are responsible for maintaining and supporting Tembira. Apple has no obligation to provide support for it.
- If Tembira fails to meet an applicable warranty, you can tell Apple, and Apple will refund the app's purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for Tembira; any other claims, losses or costs from a failure to meet a warranty are ours, as sections 9 and 10 describe.
- We, not Apple, handle any claim about Tembira or your use of it, including product-liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer-protection claims.
- If someone claims Tembira infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
- You confirm you're not in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you're not on a U.S. Government list of prohibited or restricted parties.
- You must follow any third-party terms that apply when you use Tembira (for example, your mobile data plan).
- Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you.
If you get Tembira from Google Play, the Google Play Terms of Service apply too, and Google Play's own policies govern payment and refunds.
13. Changes to these terms
We may update these terms; the date at the top changes when we do. If a change matters, we'll let you know in the app or by email before it takes effect, unless the law requires a different process. If you keep using Tembira after a change takes effect, the new terms apply. If you don't agree, you can stop using Tembira, cancel any subscription and delete your data or account; packs you've already bought stay yours under the terms you bought them under.
14. The rest
These terms and the Privacy policy are the whole agreement between you and us about Tembira. If a court finds part of them unenforceable, the rest still applies. Not enforcing a term straight away doesn't mean we've given it up. You can't transfer your rights under these terms; we can transfer ours as part of a merger, acquisition or sale of our business, and your rights stay the same. If we publish these terms in another language, the English version applies if they differ.
